A prenuptial agreement, signed before marriage, is governed by Florida's Uniform Premarital Agreement Act (Fla. Stat. § 61.079). It must be in writing and signed by both parties, and it can define property and debt rights and address alimony within statutory limits — but it cannot waive or limit child support, which always belongs to the child. To be enforceable, the agreement must be entered into voluntarily, with fair and reasonable financial disclosure (or a valid written waiver of disclosure), and free of fraud, duress, or coercion. A postnuptial agreement covers the same ground but is signed after the wedding; Florida enforces postnuptial agreements under common-law contract principles, applying similar fairness and disclosure standards.
